Pueblo County Planning and Development Department Text Message Notification Terms and Conditions

1. Acceptance of Terms

By subscribing to or using the text message notification service ("Service") offered by the Pueblo County Planning and Development Department ("Department," "we," "us"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, you must not use the Service.

2. Service Description and Purpose

The Service is intended to provide subscribers with important information, updates, and alerts regarding planning and development activities, permits, public hearings, and other relevant community information in Pueblo County.

• Frequency: Message frequency will vary depending on the activity and information available.
• Cost: Standard message and data rates may apply from your mobile carrier. The Department is not responsible for any charges incurred for receiving text messages.

3. User Consent and Opt-In

Your enrollment in the Service is contingent upon your explicit, affirmative consent. By opting into the Service, you authorize the Department to send you automated text messages to the mobile number you provide.

4. Opt-Out and Termination

You can discontinue the receipt of all text messages from the Department at any time by texting the keyword STOP to the number provided in the notification message.

• You will receive a final confirmation text message acknowledging your decision to opt out.
• You understand that opting out will only stop the text messages and will not affect any other communications you may have with the Department.

5. Data and Privacy

The Department respects your privacy. All information collected through this Service is governed by the Pueblo County Planning and Development Department Text Message Notification Privacy Policy, which is incorporated into these Terms by reference.

• We use Textedly as our third-party service provider for message delivery.
• We will only use the mobile number and optional ZIP code provided for the sole purpose of sending you the specific notifications you signed up for.

6. Disclaimer of Warranties and Limitation of Liability

The Service is provided on an "as-is" basis. The Department makes no warranty, express or implied, regarding the timeliness, accuracy, completeness, or reliability of the information transmitted through the Service.

• The Department is not liable for any delays, failures in delivery, or errors in any text message notification.
• In no event shall the Department, its officers, employees, or agents be liable for any direct, indirect, incidental, special, or consequential damages (including, without limitation, losses of data or profit) arising out of or in connection with your use of the Service, regardless of the cause of action.

7. Changes to Terms

The Department reserves the right to change these Terms at any time. Your continued use of the Service constitutes your acceptance of the revised Terms.

8. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles.
